Einführung

Hervorzuheben ist das Bank Secrecy Act , das 1970 als eines der ersten Gesetze weltweit zur Bekämpfung dieses Übels verabschiedet wurde. Dieses Gesetz, sowie seine nachfolgenden Änderungen, bilden den harten Kern des Regimes zur Bekämpfung der Geldwäsche und der Terrorismusfinanzierung

Financial Intelligence Unit

Die Financial Intelligence Unit der Vereinigten Staaten ist das Financial Crimes Enforcement Network, FINCEN , wurde 1990 unter der Leitung des Finanzministeriums gegründet. Das Hauptziel von FINCEN besteht darin, das Finanzsystem vor illegalen Aktivitäten zu schützen, gegen Geldwäsche und Terrorismusfinanzierung vorzugehen; mit dem Ziel, die nationale Sicherheit zu fördern.

Pflichtfächer

Das Rechtssystem der Vereinigten Staaten in Bezug auf die Prävention von Geldwäsche und Terrorismusfinanzierung legt bestimmte Personen und Einrichtungen als verpflichtete Subjekte fest, abhängig von ihrer ausgeübten Tätigkeit.

Zu diesen Subjekten zählen insbesondere Finanzinstitute und Banken, Versicherungsgesellschaften, Geldtransferorganisationen oder Anbieter von virtuellen Asset-Diensten.
