Regulatory framework

Introduction

Portugal, following the path of its European counterparts, owes its regulatory regime in the field of anti-money laundering to the work carried out by European Directives in this area. Its main rule in this matter is Law No. 83/2017 of 18 August; to this can be added the various regulatory provisions that help implement the rule.

Financial Intelligence Unit

The Financial Intelligence Unit competent in Portugal is the Unidade de Informação Financeira , dependent on the Judicial Police.

Obligated subjects

The legal regime of Portugal in terms of prevention of money laundering and financing of terrorism establishes certain individuals and entities as obligated subjects depending on the economic activity they carry out.

Among these subjects, credit institutions and banks, insurance companies, cryptocurrency trading portals, professionals involved in the transfer and acquisition of rights over professional athletes, as well as casinos and entities that pay prizes from betting and lotteries stand out;

Introduction

The regulatory framework for politically exposed persons in Portugal is provided by Portuguese Law, Law No. 83/2017 of August 18.

In addition, consideration should be given to the list issued by the European Commission in application of Article 20 bis of the Directive 2015/849.

Definition of PEP

Portugal defines a politically exposed person as holding positions such as:

  • Head of State, Government and members of the Government.
  • Deputies and other members of parliamentary chambers.
  • Members of the Constitutional Court, Supreme Court of Justice, Administrative Supreme Court, Court of Auditors.
  • Members of international organisations.
  • Representative of the Republic of the Autonomous Regions of Azores and Madeira, as well as the members of the governing bodies of these regions.
  • Members of the Council of State.
  • Members of the Superior Council of the Judiciary.
  • Members of the Superior Council of the Attorney General's Office.
  • Members of the Supreme Defence Council.
  • Members of the Economic and Social Council.
  • Heads of diplomatic missions.
  • General officers of the Armed Forces.
  • Presidents of municipal assemblies; Councillors with executive functions.
  • Members of the governing bodies of central banks.
  • Members of the governing bodies of independent administrative entities, regardless of their designation.
  • Members of governing bodies of political parties.

Duration of PEPs

When politically exposed persons have ceased to perform their functions, obligated subjects will continue to apply the measures provided for this type of clients for a minimum period of one year.
