Regulatory framework

Introduction

Venezuela, like other countries in its environment, also embraces in its regulatory framework provisions on money laundering prevention and terrorism financing.

Among these, the Organic Law Against Organized Crime and Financing of Terrorism stands out. Likewise, attention must also be paid to the various Circulars issued by the Financial Intelligence Unit.

Financial Intelligence Unit

Venezuela also includes within its institutional structure the figure of the National Financial Intelligence Unit. The National Financial Intelligence Unit — UNIF — is based on prevention regulations to exercise its functions in all of Venezuela's territory.

In particular, attention should be paid to Decree No. 3,656 through which the National Financial Intelligence Unit is adapted.

Obligated subjects

The legal regime of Venezuela in terms of prevention of money laundering and financing of terrorism establishes certain individuals and entities as obliged subjects based on the financial activity they carry out.

Among these subjects, financial entities and banks, insurance companies, pawn shops, lawyers, as well as non-profit organisations, stand out.

Introduction

The regulatory framework for politically exposed persons in Venezuela is provided by the prevention law and the Circulars issued by the National Financial Intelligence Unit.

In particular, attention should be paid to the Circular SIB-DSB-UNIF-16360, on measures that Obligated Subjects must implement for the acceptance and continuity of relationship with Politically Exposed Persons.

Definition of PEP

The Circular from the National Unit of Financial Intelligence divides Venezuelan PEPs into 8 major categories, each encompassing various specific positions:

  • Executive Power,
  • Legislative Power,
  • Judicial Power,
  • Citizen Power,
  • Electoral Power,
  • Police Bodies,
  • Public Enterprises,
  • Political Parties.

Duration of PEPs

When politically exposed persons have ceased to perform their duties, the obligated subjects will continue to apply the measures provided for this type of clients for a minimum period of five years.
